1. Purpose and scope
This Risk Disclosure explains the risks inherent in trading financial markets and the specific risks associated with using Tradesoft tools and indicators on platforms such as NinjaTrader 8. By installing, activating, or using our software, you acknowledge that you understand and fully accept these risks and that you are solely responsible for your trading decisions and results.

Tradesoft provides software, indicators, and educational material for informational and educational purposes only. We do not provide financial, investment, tax, or legal advice. Nothing on the Website, in documentation, backtest screenshots, examples, webinars, or communications should be interpreted as a recommendation to buy or sell any financial instrument.
3. Trading risk and potential losses
Trading futures, CFDs, forex, stocks, cryptocurrencies, or other leveraged products involves a high level of risk. You may lose all of your invested capital and, in certain cases, incur losses exceeding the amount initially deposited.
Users may lose prop firm accounts or real capital if they assign a live account to a strategy—especially when they ignore recommended risk guidelines or unilaterally increase leverage and position size.
4. Leverage, position sizing, and risk templates
Tradesoft may provide risk templates and configuration guidelines for reference, defining baseline position sizes, daily loss limits, and other protective parameters.
The user must apply such templates correctly and follow the instructions exactly. If the user modifies these settings, increases leverage, removes loss limits, or assumes higher risk than suggested, the user fully accepts the consequences of those decisions, including rapid capital drawdowns and potential account termination.
5. Performance metrics and profit factor
From time to time, performance metrics may be published (for example profit factor, win rate, maximum drawdown, average profit per trade, etc.) solely for transparency. These figures come from backtests, forward tests, or records under specific conditions and, where applicable, using recommended risk templates.
Such results do not guarantee future performance. Any change in instrument, broker, data provider, latency, commissions, slippage, risk settings, or market conditions will impact results.
6. Differences between backtests and live results
Backtests and simulations use historical data and assume certain slippage, commission, and order execution scenarios. Live markets may differ substantially due to factors such as liquidity, gaps, spikes, partial fills, platform latency, temporary halts, data errors, or changes in institutional behavior.
Therefore, live results may differ materially from any backtest, simulation, or published example.
7. Risks related to automation, platform, and data
Automated execution introduces specific risks. Platform failures, internet connectivity issues, VPS incidents, broker outages, data feed interruptions, symbol errors, or contract rollover issues can lead to missed entries, delayed exits, or unintended positions.
The user is responsible for monitoring their platform, reviewing logs periodically, and maintaining reasonable contingency plans (for example, manually closing positions during technical incidents).
8. User responsibilities
The user is responsible for selecting the instruments they trade, the account type, the broker, the data provider, and the correct installation and configuration of Tradesoft indicators or strategies.
It is the user’s obligation to read and follow the installation guide, apply risk templates when provided, review logs regularly, and ensure trading aligns with their own risk tolerance. If conditions are not suitable, the user should reduce risk or stop trading.
9. Prop firm accounts and rules compliance
Prop firms often impose strict rules: daily loss limits, maximum drawdown, news filters, instrument restrictions, trading hours, and more. Tradesoft does not bypass or modify such rules.
The user is responsible for ensuring their configuration complies with prop firm conditions at all times. Any violation may result in the immediate loss or termination of the account, even if the strategy logic is correct.
10. Recommended use and risk management
It is strongly recommended to start with simulation or paper trading, and then test with reduced risk before allocating significant capital or prop firm accounts.
It is advisable to use recommended risk templates, keep daily and per-trade risk within documented limits, avoid trading during high-volatility events or restricted news (where applicable), and not increase position size faster than your real equity curve development and your plan’s rules allow.
11. No profit guarantee and limitation of liability
No method, system, or software can guarantee profits. By using Tradesoft, you acknowledge that you do so at your own risk.
To the maximum extent permitted by law, the owner of Tradesoft, its developers, collaborators, and affiliated entities shall not be liable for direct or indirect losses arising from the use or inability to use the software, including, without limitation, loss of capital, prop firm accounts, profits, or business opportunities.
12. Regulatory status and eligibility
Tradesoft is strictly analysis software and decision-support tools. It is not a broker, financial intermediary, or investment advisor, and it does not accept or hold client funds.
It is the user’s responsibility to ensure that the use of automated strategies and analysis tools like Tradesoft is legal in their jurisdiction and complies with any applicable regulatory requirements.
13. Educational nature of materials and support
Any guide, video, webinar, trade example, context explanation, or support communication is purely educational and general in nature.
Support may help with installation, basic configuration, and clarifications about how the software works, but it will not tell you what to trade, when to enter or exit the market, or how much risk to take on each trade.
14. Acceptance of the risk disclosure
By downloading, installing, activating, or using Tradesoft software, you confirm that you have read, understood, and accept the contents of this Risk Disclosure, and that you assume full responsibility for your trading decisions and risk exposure.
